1. Introduction

Welcome to ATWD (Austin Texas Website Design). These Terms of Service ("Terms") govern your use of our website design and development services. By engaging our services or using our website, you agree to be bound by these Terms. ATWD is a division of Infodots Digital, LLC ("Company," "we," "us," or "our"), a company registered at 1178 Broadway, 3rd Floor #3427, New York, NY 10001.

2. Services

ATWD provides website design, development, and related digital services for businesses primarily located in Austin, Texas and the surrounding areas. Our services include but are not limited to:

Custom website design and development
Domain registration (1 year included)
Web hosting services (1 year included)
Logo design services
Content writing services
Search engine optimization (SEO)
Business email setup
Ongoing maintenance (optional)

3. Payment Terms

3.1 Upfront Payment Requirement

All projects require 100% payment upfront before work begins. This payment policy is non-negotiable and applies to all clients regardless of project size or scope. Payment must be received and cleared before your project slot is confirmed and work commences.

3.2 Payment Methods

We accept payment via credit card, debit card, and bank transfer through our secure payment processor (Stripe). Wire transfers may be arranged for projects over $5,000.

3.3 Pricing

All prices listed on our website are in United States Dollars (USD). Prices are subject to change without notice, but quoted prices will be honored for 14 days from the date of the quote.

3.4 Refund Policy

Due to the nature of custom creative work, refunds are generally not available once work has commenced. Cancellation requests received within 48 hours of payment and before any work has started may be eligible for a full refund minus a 10% administrative fee. No refunds will be issued once design work has begun.

4. Project Process

4.1 Project Timeline

Estimated delivery times are 7-15 working days depending on the selected plan. These timelines assume timely client feedback and provision of required materials. Delays caused by client response times may extend the project timeline.

4.2 Revisions

Revision rounds are included as specified in your selected plan: 2 rounds for Starter, 3 rounds for Growth, and unlimited for 30 days in Pro Austin. Additional revisions beyond the included rounds may be purchased at our standard hourly rate of $150/hour.

4.3 Client Responsibilities

Clients are responsible for providing all necessary content, images, logos, and brand guidelines in a timely manner. Failure to provide required materials may delay project completion. If content writing is included in your plan, you must provide necessary business information to enable accurate content creation.

5. Intellectual Property

5.1 Ownership Transfer

Upon full payment and project completion, you will receive full ownership of your website including all code, design files, content, domain, and hosting credentials. This transfer is complete and irrevocable — you own everything.

5.2 Portfolio Rights

We reserve the right to display completed work in our portfolio, website, and marketing materials unless you specifically request otherwise in writing prior to project completion.

5.3 Third-Party Assets

Some projects may incorporate licensed stock images, fonts, or other third-party assets. Where applicable, we will ensure proper licensing for your commercial use. You are responsible for maintaining compliance with any third-party licenses.

6. Hosting and Domain Services

6.1 First Year Included

All plans include one year of hosting and domain registration at no additional cost. This period begins on the date of website launch.

6.2 Renewal After Year 1

After the first year, hosting and domain renewal is completely optional. You may:

Renew hosting through us (approximately $200-400/year)
Renew domain through us (approximately $25/year)
Transfer hosting and domain to any provider of your choice
Subscribe to one of our optional Care Plans

We will provide all credentials and assist with any transfers upon request. There is no lock-in period or penalty for transferring away.

7. Care Plans (Optional)

Care Plans are optional monthly services available after your initial website is complete. Care Plans may be cancelled at any time with 30 days written notice. No refunds will be issued for partial months. Care Plans include managed hosting, domain renewal, security monitoring, backups, updates, and varying levels of SEO and content support depending on the tier selected.

8. Limitation of Liability

To the maximum extent permitted by law, ATWD and Infodots Digital, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

We do not guarantee specific results from your website including traffic, leads, sales, or search engine rankings. Website performance depends on many factors outside our control.

9. Indemnification

You agree to indemnify and hold harmless ATWD, Infodots Digital, LLC, and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York County, New York.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

13. Severability
